Civil marriage procedures in Malaysia

From 1 January 1995 Australian consular and diplomatic officers are no longer empowered to perform marriages overseas. Since that date, any legally performed marriage in an overseas country, which would have been legal had it been performed in Australia, is accepted as a legal marriage under Australian law.

The office of the National Registration Department has provided the following information regarding Non-Muslim civil marriage procedures in Malaysia.

There is no difference in requirements or procedures for Australian citizens who are a) tourists, b) residents of Malaysia, or c) Australian citizens marrying Non-Muslim Malaysian citizens.

In order to register your marriage in Malaysia, the civil authorities require Australian Citizens to obtain either a Single Status Certificate or a Certificate of No Impediment.

Single Status Certificate

Single Status Certificates can only be issued by the Registrar of Births, Deaths and Marriages in accordance to which state the applicant is resident in. The High Commission can not assist in the issuance of these certificates and all enquiries must be directed to the relevant authority.

Certificate of No Impediment 

  1. Both the couple must be present at the time of application 

  2. The form” Application for Certificate of No Impediment to Marriage” should be completed by both couple. 

  3. Consular fee AUD140.00 (Ringgit Malaysia 441.00) is charged. Please note that we accept payment for passports and notarial services by credit/debit card (Visa or MasterCard only) or local Malaysian bank draft only. We do not accept cash, American Express or personal cheques. Bank drafts should be made payable to the "AUSTRALIAN HIGH COMMISSION" in Malaysian Ringgit.

  4. Evidence must be sighted before the certificate is issued:

    • Both couple’s original passports 

    • Both couple’s original birth certificates 

    • If either party is divorced or widowed, the relevant decree absolute or death certificate must be sighted
